Information covered by this Privacy Notice

This includes information such as your name, date of birth, address, email address, telephone number, and payment information; your preferences and communications with us; technical and device information; and information relating to your training and fitness, including height, weight, body measurements, body composition, workout and strength/fitness data, mood, sleep, stress and recovery, meals and nutrition, menopause or perimenopause information, injuries, medical conditions, medications, HRT information, allergies, physical and mental wellbeing information, other health information, and progress photographs.

Some of this information, particularly information relating to your physical or mental health, constitutes special category personal data under UK data protection law and is subject to additional protection.

Personal data we obtain

We may obtain personal data about you in various ways, including when you make a purchase, complete a form, make an enquiry, book a session, create an account, complete a questionnaire, provide measurements or photographs, log workouts or meals, take part in check-ins, communicate with your coach, take part in group coaching or community chat, join our email list, download a resource, opt in to marketing, complete a survey, interact with us on social media, or otherwise correspond with us.

Information collected when you use our website

When you use our website we may automatically collect information such as cookies, your IP address, browser type and version, device type, operating system, approximate location, time zone, the pages you view, the site that referred you to us, the products or services you viewed, the time you spend on a page, and how you interact with our site. Information collected through coaching platforms and apps

We use third-party coaching platforms and apps, such as Trainerize or equivalent, to deliver our coaching services. Through these platforms we may collect information about your workouts, including reps and weights, other fitness activities, nutrition, body measurements, progress photographs, weight, sleep, habits, steps, cardio and heart-rate data, and messages between you and your coach. Where you choose to connect a fitness device or health app, such as Apple Health or Google Fit, we may also receive data imported from that device or app.

How we use the information we obtain

Managing your account

We use your information to set up and manage your account, process your orders and payments, and provide you with customer support.

Providing coaching services

We use your information to provide personalised strength and fitness programmes and nutrition guidance, to help you set goals, to monitor your progress, to review your body composition and training performance, to give you feedback, to adapt your programme, to support your habits and consistency, and to manage your training, nutrition, sleep, stress and recovery. Where relevant, we also use this information to provide menopause and midlife coaching, to identify any safety factors we should be aware of, and to make informed decisions about your coaching.

Group coaching and community features

Where you take part in group calls, online communities, group chats, workshops or challenges, other participants may see information you choose to share. We are not responsible for what other participants do with information shared in these settings.

Marketing

We will only send you electronic marketing where we have your consent to do so, in accordance with the law. You can unsubscribe at any time using the link in our marketing emails or by contacting us at info@kickasscoaching.co.uk. Unsubscribing from marketing will not stop us contacting you about your account or the services you have purchased.

Customer feedback and surveys

Taking part in feedback and surveys is voluntary. We use the information you provide to improve our services.

Payment processing

We use third-party payment providers, such as Stripe, to process payments. These providers collect information such as your name, billing address, card details, payment amount and transaction information. We do not normally receive or retain your full card details.

Performance of our contract

We process your information where this is necessary to perform our contract with you, under Article 6(1)(b) UK GDPR.

Legitimate interests

We process your information where this is necessary for our legitimate interests, under Article 6(1)(f) UK GDPR, provided this is not overridden by your interests or fundamental rights.

Legal obligations

We process your information where necessary to comply with our legal obligations, under Article 6(1)(c) UK GDPR, for example for tax, accounting and financial record-keeping, regulatory purposes, or to respond to a lawful request.

Consent

Where we rely on your consent, under Article 6(1)(a) UK GDPR, you can withdraw that consent at any time.

The use of consent for processing health information

Information about your menopause or perimenopause, injuries, medical conditions, medication, HRT, allergies, physical limitations, mental wellbeing, weight, surgery, symptoms, reproductive health or recovery is special category data under Article 9(2)(a) UK GDPR, and we process it only with your explicit consent. You can withdraw this consent at any time, although doing so may limit our ability to provide coaching to you safely.

Progress photographs

We use progress photographs to monitor your results, unless you give us separate permission to use them for marketing or other public purposes.

Testimonials and case studies

Providing a testimonial or taking part in a case study is voluntary. Where a testimonial or case study includes identifiable information, health information, or photographs that we would like to use in our marketing, we will ask for your separate permission first.

Third parties

We do not sell your personal information. We may share it with trusted third parties who help us run our business, including Trainerize, Stripe, Zoom, our hosting providers, email and marketing platforms, form providers, booking software, cloud storage providers, our accountants and bookkeepers, our CRM provider, WhatsApp or other messaging platforms, Meta, Google and other advertising and analytics providers, IT and technical support providers, and our professional advisers. We may also share your information with regulators, law enforcement, courts, HMRC and other public authorities where required, or with advisers in connection with the sale or restructuring of our business.

Our website may contain links to third-party websites. We are not responsible for the privacy practices of those websites, and we encourage you to read their privacy notices.

How long we retain your personal information

We retain your personal information only for as long as necessary for the purposes we collected it for, and we review our retention periods regularly.

International transfers of personal information

We may process your personal information outside the UK, for example in the United States. Where we do so, we rely on UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or another lawful transfer mechanism.

We use password-protected systems, restrict access to your information, use two-factor authentication where available, use secure cloud services, and restrict access to your information on a need-to-know basis. Access – You have the right to ask us for a copy of your personal information.

Rectification – You have the right to ask us to correct information you think is inaccurate or incomplete.

Restriction – You have the right to ask us to restrict the processing of your information in certain circumstances.

Objection – You have the right to object to our processing of your personal information in certain circumstances, including an absolute right to object to processing for direct marketing.
